If YouTube hosts copyright infringement files, they pay the uploader for the number of views too. It's only taken down when they are requested. Nothing happens to the uploader. YouTube owners aren't arrested.
How are YouTube not an illegal racketeering company also?
Megaupload also took down files upon request.
To say innocent until proven guilty doesn't apply is ludicrously dangerous precedent to set.

Not only did they plan on allowing artists to keep 90% of their earnings on songs that they sold, they wanted to pay them for songs they let users download for free.
"We have a solution called the Megakey that will allow artists to earn income from users who download music for free," Dotcom outlined. "Yes that's right, we will pay artists even for free downloads. The Megakey business model has been tested with over a million users and it works."

I suppose the FBI were concerned that if they tried a more measured approach, i.e. going to Dotcom's place with an arrest warrant, he would block them and stage an escape. He's in New Zealand though, there are precious few places to escape from or to. Anyway they could have had the helicopter and all the special force's dust-gathering equipment on stand-by if things didn't work out. But no, they wanted a dramatic raid to justify their funding and now Dotcom's using it to garner sympathy for himself.
He's running a pretty interesting public relations campaign here actually, trying to come across as the friendly millionaire who was wronged. Invited random strangers to his place for an impromptu party a month or so ago.
