No you couldn't. A person can use megaupload for thousands of non-copyright infringing reasons. Especially people into making media of sorts like photography, montages of various genres, etc.

Anything you view on your pc you have downloaded. Any copyrighted picture you look at has been download to your pc, otherwise you wouldn't be able to see it. If it is completely illegal to download copyrighted content then you cannot have copyrighted content on the internet. No songs, no professional photos, no articles, no journals, no company logos no anything. Nobody has yet come up with a way to differentiate this useage, hell look how shite their law proposals currently are. Its a waste of time.

Sucks for them but these things happen. Let's be fair though, those people are as much a victim of Kim Dotcom for failing to protect the integrity of his service as they are of the FBI for shutting it down.

I don't like the people who've romanticised Kim Dotcom and portrayed him as a victim and a hero. Let's be clear about who we're dealing with; this is a guy who's career consists of being convicted for stealing credit card numbers, embezzlement, fraud and insider trading. With Megaupload he provided a standard uploading/downloading service and while I doubt he himself was responsible for uploading any illegal files he sure as Hell profited from others doing it. Dotcom knew the service he was running and he did as little as possible to police it because he knew what his customers were paying him for. As far as I'm concerned this investigation and the shutting down of Megaupload and its affiliates is simply the result of a lifetime of using corrupt means to get rich.

I don't know if current legislation is strong enough to convict Dotcom of anything. I certainly don't think current copyright law would do it and what's more I don't even think he should be convicted of copyright infringement based on current law. To be honest on this count he's no different than the thousands of other rich guys who find technically legal ways to profit from technically illegal activities. That is I imagine why they've flung the net wide and charged him with a number of things - after all Al Capone was finally done in for tax evasion. But the point remains that he is a fucking crook and I am not shedding any tears for him. I'm certainly not throwing my support behind the guy, the only people who seem to be are those who haven't actually learned about the larger situation and are only upset because now they can't download the latest episodes of whatever shit TV show they like.

Copyright law won't be strong enough to get him for copyright infringement or distributing copyrighted material, it'll be one of his other shady deals that'll get him. I don't think those behind the Megaupload shut-down care as long as he's out of the way - and to be honest I don't begrudge them for that. It's not like Kim Dotcom doesn't deserve it and it's not like it will kill piracy.

There's this guy I really dislike on The Escapist, Jim Sterling. I watched one of his videos that looked at piracy and can't deny that he's right on the money with his criticism of copyright law. At its inception copyright was meant to protect the rights of the creator of original material but the fact that copyrights can be bought and sold means that copyrights are generally held by these powerful groups that generally only exist for the purpose of their own self-advancement, (groups like the MPAA and RIAA for example.) With digital distribution making these guys largely irrelevant these groups are just struggling to keep themselves alive - because what do they actually do any more? They're mouthpieces that claim to protect artists' interests or the industry's interests but they don't, they just try to ensure their own survival. That and claiming all the copyrights they can get their hands on which is a perversion of a system that was meant to protect creators' interests, not the non-creative faceless industry's interests. With these groups unjustly 'owning' material who the Hell are they to claim that people are stealing from them? To steal an analogy it's like a burglar complaining that he got mugged on his way back from ransacking someone's house.

I suppose the FBI were concerned that if they tried a more measured approach, i.e. going to Dotcom's place with an arrest warrant, he would block them and stage an escape. He's in New Zealand though, there are precious few places to escape from or to. Anyway they could have had the helicopter and all the special force's dust-gathering equipment on stand-by if things didn't work out. But no, they wanted a dramatic raid to justify their funding and now Dotcom's using it to garner sympathy for himself.

He's running a pretty interesting public relations campaign here actually, trying to come across as the friendly millionaire who was wronged. Invited random strangers to his place for an impromptu party a month or so ago.

I think most people are agreed the man is a knob and a crook however the US are really trying their best to make themselves look as bad as possible.
