Treacy is facing a first-degree attempted murder charge for the March 17 incident. The Sheriff's Office said he bicycled from his home to the middle school to seek out Ratley after she sent him a text message that made a reference to his dead brother. Wearing steel-toed boots, he allegedly stomped on her head up to seven times as she lay on the ground defenseless, according to an arrest report.

The results of the beating are clear in a series of disturbing photographs released by Ratley's family Monday. The pictures of the battered 15-year-old girl show stitches on both sides of her head, the scars of two surgeries she's endured at Broward General Medical Center.

Our system needs a major overhaul regarding charging minors.

Usually, the only reason minors are charged as adults is because laws regarding minors are more lenient regardless of the crime. If we actually adapted the laws in a reasonable manner to cover serious crimes committed by minors, there would be no need to charge them as adults.

That being said, charging this minor as an adult is all the current system allows room for, due to the severity of the crime.

It's only because the system hasn't properly accounted for serious crimes committed by minors. The prosecution has little choice but to do this in order to properly address the crime and investigation.

What will often happen is that sentencing is reduced because of the accused's age. Granted, the sentencing itself is largely dependent on the judge.

The problem with the current system is that it essentially gives a judge the power to treat a minor the same as an adult in sentencing. The level of mercy/retribution shown is entirely up to the judge once conviction is obtained.

A more properly designed system would already take into account incidents where minors commit or attempt murder, so that sentencing is more relevant to the minor's age and judges would have less power to express their biases in either direction.

At the age of 15, you know the difference between right and wrong. The kid knew that by putting on Steel-toed boots and stomping a person would inflict a massive amount of damage to someone. I have no problem with him being tried as an adult.

If there was a system in place for it, yes. Granted, even when sentencing a minor of something of that magnitude, the time served is likely to be many decades. People don't exactly get out early for good behavior after doing something like that -- and for good reason, obviously.

Having a better designed system to charge minors with is less for the benefit of extreme cases like the one you are positing and more for the less clear-cut ones. When motives are debatable and evidence is questionable, the comprehensiveness of law is more important than usual.
