Sorry for your loss, but in the picture it looks highly likely that the driver was in the left hand lane and could have moved over to right with out looking.
Look at that picture, that's one hefty rear end. Obviously he was speeding, and the other car she was in must have been stationary at a light or something. That's what it looks like. Plus being drunk inhibits your reactions, so that one picture just all points one big giant guilty. But I know there are cases of people drink driving, having an accident not of their own fault whatsoever but still getting the slam once the breath test comes along. But this ain't one of them.

Still not so sure. I just don't like assuming things, Drinking does inable reaction time but so does texting.

Haven't seen any crash tests on those car but majority of modern cars are made to break away such as that to absorb instead of deflect. I don't see any skid marks on the road which everyone drunk or not would have tried to slam on the breaks.

Her car was stopped at a red light. Can't exactly see and avoid in that situation.

As for outlawing booze: been there, tried that, did the exact opposite of the intention of the law. Made the mob lots and lots of money.

Well in a case like this is imprisonment the answer? Maybe make an ID that wouldn't allow him to purchase drinks or booze from a store? Which would be easy to implement, and less costly to tax payers.

Yes. It's a punishment. They've proven themselves a danger to society (especially when they've had previous DUIs on their record).

While rehab for the first, non-victim DUI would be nice, if they continue to show that they are not changed by the rehab they should be locked up.

Also, requiring IDs for alcohol hasn't stopped its sale to minors.

edit: He also should be barred from ever buying a motor vehicle or getting a driver's license.
