Normally at the end of hostilities of a war you exchange prisoners.  But in this case whom do you exchange them with if they never fought for a uniformed army and the countries that they came from refuse to take them back?

If they weren't terrorists when they went in, they are probably now.

If they weren't radicalised before they are now, but the USA has to deal with the consequences of poor decisions. 'Hey lets just grab a bunch of dudes, who knows what they were doing but they were in the area and are young men so lets lock 'em up!'

A lot of the gitmo detainees were released without charge over the years. I think it was about 2/3rds of the original inmates though somebody might be able to correct me on that.



Btw Sniper3, Australia's already been asked twice to take in former inmates of gitmo. Refused twice too.

To quiet those who don't bother to read the GC. And also because the GC was written in the context of nation state vs nation state. It is inadequate to cover non-state actors.

It is followed by those who signed it. There is language in it that basically says those who sign it have to abide by it until the other side doesn't...whether the other side is a signatory or not. AQ and others have not abided by it from day one.

Keep Gitmo open until hostilities in Iraq and Afghanistan are concluded. They aren't due charges or trials, per the GC, unless we choose to hold them beyond the end of hostilities.
