he did have his legs on. it's a major part of the prosecution's case w/r/t premeditation that he affixed his prostheses, took out his gun, walked 7 metres, and then fired 4 shots. those very particular facts purportedly make it an empirical fact that he pre-planned the murder. putting on legs; taking out a weapon; walking some paces; firing more than one shot. in the law there's a precedent for self-defense in cases of burglary/home invasion that basically justifies it if the home owner wakes up and 'find the burglar over his bed' (or something to that effect). this is like an over-arching uk common law point. the prosecution are trying to prove, precisely, that his panic-in-the-dark was not this state of instant-reaction defense.
