To anybody that hasn't been paying attention to tech news recently, Apple sued Samsung for patent infringement on many of it's mobile products. Essentially Apple is saying Samsung copied Apple's ideas with the iPhone and iOS.

On friday the jury ruled in favor of Apple and awarded them a 1.05 Billion (US) Dollar settlement saying the "evidence was overwhelming".

Personally I'm pretty anti-apple. Not because they don't make a good product (they do), more because they shut 3rd parties out. I understand having everything under one roof is to make it all work in sync but doing so COMPLETELY removes competition advancement from the tech world. Having full control over your products doesn't push you to make better ones and nearly the rate it would if you compete. The rate mobile phone tech has been advancing has been amazing and I personally think this ruling will slow it down, only so Apple can have more money.

"Stealing" technology has existed far before patent rights were invented and far after. Since though, one need only find the fine line where they aren't stealing tech but only using it as a rough idea on which to build a product different enough. It's a very slippery slope to allow a 'certain' amount of technology to be 'borrowed' before it becomes stealing but where do we draw the line? Did we just find out with this ruling?

Which is why Apple won the case in California and Samsung won the same case in Korea (still lost one aspect of it - to do with bounce back scrolling).

Patenting aesthetic things like rounded corners or bounce-back scrolling is stupid and is solely for the purposes of killing competition. I agree with Jay.

I think it's an especially scum-bag move that this is coming from Apple. Apple is an innovative company, they make some great things but they have always been shameless about stealing and adapting other people's ideas. There is an interview with Steve Jobs some time in the 90s, I'm sure you can find it on YouTube, [edit: Pirana posted it] where he quotes Picasso's "Good artists copy, great artists steal" and says, quote, "We have, you know, always, ah, been shameless about stealing great ideas."

Cut to 2010 when Apple faces competition from Android. Steve Jobs again: "I’m going to destroy Android, because it’s a stolen product. I’m willing to go thermonuclear war on this." Even worse he said he wasn't interested in getting any money from the so-called patent thefts, he was simply dedicated to killing off the items completely.

Now that's just not cricket. When the Australian CSIRO invented wi-fi, (accidentally,) their patent was stolen and used by a huge range of companies. Wi-fi I think is a far more important patent than a bloody phone touch-screen and the CSIRO was understandably upset, they went to court, won, but allowed all these companies to continue to use the patent in exchange for a minimal licencing fee. Obviously the CSIRO is a research body and isn't interesting in competing in electronics manufacturing but this sort of thing isn't uncommon, even among competing companies. If Samsung were smart they'd try and pursue something like this with Apple instead of running it through the courts which may end up costing them significantly. But if Apple have maintained Jobs' attitude of “I don’t want your money... I want you to stop using our ideas in Android, that’s all I want,” then no-one's going to get anywhere.

There's also the questionable jury as well, taking a day to mull over documents that should have taken a week, all the other tell-tale signs that they made up their minds just by looking at the two similar products. I don't think Samsung will have a problem appealing.

Honestly I fucking hate the smart phone race. All this science and technology and innovation dedicated to coming up with new gimmicks in handheld devices where the most important thing isn't the application of technology but the marketing of it. Waste of time, money, and the talents of bright people who would be better spent working on a hoverboard in time for 2015.

the only moderately legitimate patent infringement they had was the bounce back one.  everything else shouldve been thrown out immediately. so many flaws in the decision that its going to change in a huge way upon appeal.  i really hope apple gets hit back with their blatant copying of the pull down notification bar too.

one of the best analogies ive heard about this was that it was a cold war up until now with companies stockpiling patents as deterrent.  but not that apple has started to fire shots, everyone is going to be on their ass - and they have the smallest patent portfolio of them all.

Also flouting other people's patents because you're bigger than them can can drop lawyer-death on them with impunity.

The US patent system is beyond stupid, its so swamped everything gets rubberstamped, I was up against a patent which covered a box with an electrical connection on one side and an optical connection on the other.

Another example - many industries have committees working on common standards, USB for example.
Attending a meeting and running off to patent everything you can think of which could be relevant to fuck everyone else is abuse.

My Walkman was a rectangle with rounded corners. So was my old Nokia phone. I guess they can both sue Apple now. Afterall, one is used for entertainment, and one is used for communications... I believe they stole those ideas for their idevices.
