Plaintiffs Dianna and John Dariano, parents of Matt Dariano; Kurt and Julie Ann Fagerstrom, parents of Dominic Maciel; and Kendall and Joy Jones on behalf of Daniel Galli filed the lawsuit against the school district alleging violations against their First and Fourteenth Amendment rights after their children wore American-themed T-shirts to Live Oak and were sent home after refusing to remove the shirts and apparel after Boden and Rodriguez were concerned about the potential for violence on campus. The fourth student, Austin Carvalho or his parents, did not file a lawsuit.

The four students were told by Boden and Rodriguez on May 5, 2010 they could wear their American flag T-shirts on any other day other than Cinco de Mayo. After Rodriguez called the students into their office, Boden let two of the original five students return to class, including Dariano. The other two students were told to either turn their shirts inside out, or go home for the day as an excused absence. The two, Dominic Maciel and Daniel Galli left school for the day. Dianna Dariano chose to remove her son Matt for the rest of the day, although he had been allowed to return to class.

Other students that day May 5, 2010, wore red, white and green in favor of their pride for the Mexican holiday.
Every other day a story comes out of either Cali or some other border state about some race issue or other crap they are having. I'm curious as to why there are so many problems with race over there and not in other places in the United States. For instance, the north east is as diverse as the south west and it's very racially stable. All of the races get along in my part of the country... So what is it about that part of the U.S. that they can't "all just get along"? I don't think the whole immigration thing is the root of it all since the last major race riot we had was by blacks in Cali. So what do you think?

Can you link the article in the op?

Doesn't seem like a race problem do much as a) parents projecting their political views through their kids; b) out of touch teachers.

Most kids in elementary school are making an effort to be more like their peers, so why did these kids wear American flag t-shirts on cinco de mayo when everyone else wore Mexican flag colors? Reeks of parental interference.

Did the teachers really have to take such a hard line stance? 

Then again, I'm assuming it's elementary school level because there's no source article in the op....

California used to be Mexico, some sensitivity one day a year isn't unreasonable.

Stupid parents trying to rub their flag into Mexicans faces via their kids is pathetic.

Maybe kids should go to school in KKK outfits on MLK day - exercise their free speech and so on.

The issue in the OP has been dumb since the very beginning. If wearing clothing with American flag decals causes trouble within American borders, the problem is more far-reaching than a few t-shirts.
