how about the real miscarriages of justice that go on every day? Namely that nonviolent offenders convicted on drug charges often serve lengthy mandatory minimum sentences, while animals who have been convicted multiple times for violent and property crime get a couple years at most.

And then they go on to kill seven people, including a child.

http://www.cbsnews.com/stories/2011/07/ … eakingnews

A gunman opened fire in two Michigan homes Thursday, killing seven people, including a child, then leading police on a high-speed chase through downtown Grand Rapids before taking two hostages in another home, authorities said.

Within hours, dozens of officers with guns drawn had cordoned off a neighborhood near a small lake in the northern part of the city and shut down nearby Interstate 96. With the suspect surrounded, state police warned residents to stay in their homes.

Dantzler has a criminal record, he plead guilty in 2010 to assault and battery and served about a year. In 2000 he entered a guilty plea to assault with intent to do great bodily harm less than murder and was sentenced to three to ten years.

In 1997 he was given a year of probation for malicious destruction of property, and in 1992 he was charged as a juvenile for breaking and entering.
So let's see. Breaks into someone's house or business in '92. Five years later he destroys shit. Three years later he assaults someone "with intent to do great bodily harm less than murder." Goes to prison for a bit and then once again commits assault and battery and gets let off in a year. Real upstanding fellow, glad he was allowed to roam freely!

e: Apparently they've got the fucker surrounded...

His record doesn't seem that bad. I mean- I've seen a lot worse records with much less punishments. Quite frankly it seems he served his time for those and now has snapped and killed a bunch of people. Can't hope for the justice system to do much more unless you want to go full draco and up the punishments for everything. That creates a whole bunch of other issues but hey, pick your poison.

Well, I suppose if you start handing out heavier sentences, incorrectly accused people would be jailed for ridiculous time they shouldn't be serving.

What happens in court and what the press report often bear no relation.

I don't like mandatory sentencing or giving judges too much leeway.

From talking to a few insiders, this one was doomed from the start.  A total cluster form top to bottom.

working with circumstantial evidence and inconclusive DNA testing, is a tough sell for a jury to buy.

The sad thing is that they could have put her away for a good amount of time if they would have just went for what was an absolute fact.

I'm tired of getting request to sign the petition for Caylee's law.
There should be a new law created called Caylee's Law that will make it a felony for a parent or guardian to not notify law enforcement of a child going missing within 24 hours

Let's keep another case like Caylee Anthony out of the courts.  Contact your State Senators and Representatives.
Erm.. Caylee was never missing. This is true whether you believe the defense or not. This is people who are frustrated and can't do anything about it. Not reporting a missing child already falls under a handful of laws.

So you would rather have loads of rapists, murderers, paedophiles serving lenient sentences, and the odd wrongly-accused person serving a small sentence over the prospect of these rapists, murderers and paedophiles serving proper, long sentences?

It is better to risk sparing a guilty person than to condemn an innocent one.

True - That's the whole point of 'innocent until proven guilty'.

But really, can't we get some common sense back into the judicial system?

Currently, it seems more like blindfolded lady justice is holding out her scale to judge how much coin you can put into your defense.

And the jury 'of your peers' is more akin to a jury of 'twelve people too stupid to get out of jury duty'

As for miscarriages of justice-
Thompson, a student at MSU's College of Osteopathic Medicine, later told investigators he killed the puppy out of anger by slamming it against a wall.

The reason he was angry, Ingham County Animal Control Deputy Jodi LeBombard testified: "He had witnessed the dog urinating in his bedroom."

The 24-year-old from Arizona was ordered Friday to stand trial on charges he killed or tortured three Italian greyhound puppies.

He faces up to four years in prison.

Thompson, who has been suspended by the college and is being held at the Ingham County Jail on separate bonds totaling $600,000, also is charged in 55th District Court with 10 additional counts of killing animals.
...
It was revealed in court that Thompson suffers from bipolar disorder. Court documents say he was seeing a psychiatrist.
Killing puppies isn't nice but it looks like this guy is more in need of psychiatric care than a prison sentence.

I saw on the news a few days ago a story about a man who went and shot to death another man over a bicycle. The murderer in that case is on $500,000 bail.

How is a mentally disturbed person getting such a high bail, having their photo and name plastered across the internet, and facing four years in prison for killing some puppies 'justice'? I know people really like animals and all but this isn't fair. He could have mugged someone on the street and would be facing a shorter sentence and a lower bail.

It's sad that people will bitch about Casey Anthony getting off as a travesty of justice yet ignore the many abuses of the criminal justice system that occur without notice everyday in the U.S. But I guess being on T.V. makes things more important.

Indeed. At most some time in a medium secure psych ward with a case a weekly case manager once he he is deemed psychologically sound enough to return to society. Prison will just exacerbate his illness further and potentially drive him to worse - it appears he already has those tendencies.
