Which isn't the same as a patent. OP is talking about doing away with software patents (or patients ) not copyright.

Patents, Trademarks, Copyrights, etc are all protections for intellectual property and serve the same general purpose. If the software were copyrighted instead of patented you would still need a license to use or reproduce it.

So we aren't that far apart. So maybe the issue for me is, there needs to be something to weed out the trolls (i.e. attempting to patent a 'buy now' feature).

Yeah, he was pulling in six and a half figures for 2/3 a years work at his peak. Then they started outsourcing to India and asking him to work for $50k for a full years work. He quit and it's a good reason that he's the bum he is today.

If you read the patent documents, there isn't any source code.  No way to 'change X+Y to Y+X'and avoid the patent, since none of that is included...just an abstract method for one-click shopping online.  The question is--should that be patentable?
