WASHINGTON -- The U.S. released one of the youngest detainees at the Guantanamo Bay prison and sent him home to Afghanistan, the Justice Department said Monday.

Mohammed Jawad, who according to his lawyers may have been as young as 12 when he was detained and moved to the detention facility at Guantanamo Bay more than six years ago, was released in the past day, said Jonathan Hafetz, his American Civil Liberties Union lawyer. The U.S. government says Mr. Jawad was 17 when detained.

U.S. District Court Judge Ellen Segal Huvelle last month ordered Mr. Jawad's release. She said if federal authorities wanted to charge him in U.S. criminal court they should do so by Aug. 21. The judge criticized the government's handling of the case.

Authorities said Mr. Jawad allegedly threw a grenade that wounded two U.S. soldiers in 2002. Mr. Jawad has maintained that he is innocent and was tortured into confessing, his lawyer said. Federal authorities said recently that they were no longer relying on any statements Mr. Jawad made after he was subjected to harsh interrogations.

A Justice Department official said Mr. Jawad's release didn't preclude charging him in the future.

The Obama administration is pushing ahead with plans to close the Guantanamo prison by January.

Trust the lawyer.  He said that, so it's got to be true.  Is there evidence THIS GUY was totured?

Just like there is nothing concrete to hold him.

We will not know if the guy actually did this, and fortunately (note choice of words, Mr. Instigator) the burden of proof is on those charging the defendant.

So, either the guy is guilty and goes free, or he's not and goes free.  In both cases, it's unfortunate its taken so long to release the guy.

I have a hard time believing the US grabs random 12 year olds in a hot zone...but if thats what you believe, I'm not going to change your mind anyway...

You are implying the judge is pissed because this guy was innocent.  I would think he's pissed because the army did a shit job on charging the guy.  I'm pissed, like the judge, about all the resources wasted, the poor guy unneccesarily detained if nothing would have come of it, and the possibility of a botch which may have put the guilty party back on the street.

Like I said, it would have been easier to shoot the kid.  But they didn't so I'm proud of that at least.  I imagine the possibility of a trial for a US soldier would be a novelty, if the situation was reversed.

yes I do. Learned in a movie when guy was held in custody but someone paid bail and he got released.

You know those american reporters Laura Ling and Euna Lee who were detained in North Korea for illegally entering the country? Remember how everyone called N.Korea an evil totalitarian dictatorship with no respect for the basic human rights? Imagine if they were 12...

But capturing people and sending them to gitmo without any trial or proof is a direct breach of the human rights/ Geneva convention / wtv you call it.

The treatment of prisoners at Club Gitmo is far better than the treatment of N. Korea's prisoners. They weren't facing hard labour in a mine for the rest of their lives.
