Iraqi shoe-thrower's jail term cut

An Iraqi journalist who threw his shoes at George Bush, the former US president, has had his sentence reduced from three years to one, a court spokesman has said.

The news came as a surprise to Muntadhar al-Zeidi's family, who called it "a victory for the Iraqi people" on Tuesday.

The decision was made as al-Zeidi had no prior criminal record, an official said.

The defence appealed against the original ruling to the Federal Appeals Court citing an Iraqi law stipulating a maximum sentence of only two years for publicly insulting a visiting foreign leader.

A-Zeidi, 30, has become a folk hero across the Arab world since the attack, where Bush is reviled over the 2003 US-led invasion of Iraq.

The shoes narrowly missed Bush, who was addressing a news conference with Nuri al-Maliki, the Iraqi prime minister, during the incident last December.

Expression of freedom

Lawyers have long argued that al-Zeidi's act was an expression of freedom and not a crime.

"We think al-Zeidi does not deserve to be imprisoned even for one day," al-Zeidi's chief defence attorney, Diaa al-Saadi, told the Associated Press news agency.

"What he has done falls in the category of freedom of expression and he was trying to express his anti-occupation feelings," Yahya al-Ittabi, another lawyer for al-Zeidi, said, welcoming the court's decision.

He said the fact that the court did not bow to government pressure to uphold the existing sentence, reflected the "independence and the integrity of the Iraqi judiciary system".

Al-Zeidi has been in Iraqi custody since the  attack and though he is scheduled to be released in December 2009, his lawyer said he could be free within five months with credit for good behaviour.

Thats a good point. Protest by any means, but assault (which sadly, is what this was) is the breaking point.


On the other hand, we're trying to apply western logic to an area of the world that isn't western, and holds different values and ideals. One of the main reasons invading countries over there will rarely work tbh.

Indeed, we dont run on the same mindset, we dont try and pass law to be able to rape our women...

And we should not be invading em at all, if there is something we should do is drop a big load of old Ak's over there and let the problem solve by himself. Right now the USA, Canada, Uk,Germany etc etc that is in this conflict have better thing to do than trying to fix someones else country, They should be home fixer their country before doing anything. Sooo much money spent on this pointless war...could have helped the economy, the road condition, the hospital and all...but nooo, the evil iraqis are threatening the world....Duh!

He threw his shoes... and missed, and got three years for it (now reduced to one). Let's see how much time this cop gets for assaulting that innocent pedestrian who subsequently collapsed and died during the G20 protests. It seems "justice" these days is relative to whatever title you have before your name or what colour uniform you have on.

Can you kill someone with a shoe from that distance? His throw didn't look that good on the video footage.

So he should have been punished for attempted assault... in my country I've seen people get suspended sentences for full blown grievous bodily harm and this guy gets a year inside for missing a war criminal with a shoe, that's what I find unfair.

Given the context he should have gotten a suspended sentence and a slap on the wrist imo. If Bush had any sense he could have shown himself to be a gracious war criminal and pushed for clemency, it might actually have improved his profile if that were at all possible.

What's hypocritical is people thinking that the guy throwing the shoe quite rightly deserves to be in prison while the murdering war criminal who the shoe was aimed at should be allowed to walk out the door and enjoy his retirement.

Look at the wider picture of what has happened in Iraq... a bogus reason to go to war, lies about WMD, a bombing campaign of "shock and awe" proportions, a society reduced to chaos, women and children slaughtered, ethnic tensions unleashed, thousands upon thousands of people injured, millions of lives ruined and while the guy responsible for kick starting all of this sits back on the ranch and enjoys his retirement an Iraqi who threw a shoe at him in disgust at the carnage inflicted on his country sits in a prison for a year.

...that's just not fair in my book. I understand the guy broke a law but in my personal opinion it pales in comparison compared to the laws broken by the man he aimed the show at.
