Q: what are you thinking?

http://www.dailymail.co.uk/news/article … judge.html

Lord Chief Justice Lord Phillips said that Islamic legal principles could be employed to deal with family and marital arguments and to regulate finance.

He declared: 'Those entering into a contractual agreement can agree that the agreement shall be governed by a law other than English law.'
I think some of that wig material worked it's way into his brain.

My question is this: if it is a contractual agrement other than British law, how would either party expect it to be governed by British law when one or both parties faults?

They don't.

As long as punishments don't contravene British law, then I don't really see any problem with this - it's like having a gentleman's agreement - it's not legally binding, but is informally binding - only in this case, any agreement entered into under Sharia law wouldn't be binding by British law, but may be by Sharia law.

No as that would go against a British law.

Aw cmon you know as well as I do that that wouldnt become legal man. Sharia courts for family and bussiness afairs, aswell as Jewish courts for the same things exist in many countries. They work within the paramaters of the native law and just take off a burden from the standard courts.
Sharia court even operates in Israel.

I don't know what the big deal is. As the Lord Chief Justice said, as long as people enter into that contract voluntarily, what's the problem. No one is forcing them to follow sharia law if they don't want to.

"...mediation or other forms of alternative dispute resolution". Same as the Jewish courts they have over there in the UK.

PS The Iraqi constitution, the one supervised by the US, states that all law must come from Sharia.

They already use it unofficially to sort out disputes. As Poe said. There is already Jewish courts. Are the hoards of Jews coming over the hills to ruin our way of life?

It will be superseded by UK law anyway.

We appease the Christians here in N.I, with a higher age of consent and no abortion which differs from UK law. And we are part of the uk.

It's not a big deal, it sounds scarier than it actually is. As stated by others in this thread it's no different to the Jewish courts in the UK that no one ever seems to complain about.

I think it goes back to the old days when the plague and other such nice diseases were around. I think the wigs were either to protect the hair from harbouring nasty molecules and germs or because they were all bald because of lice and wanted the illusion of hair...can't remember exactly, not sure if that's even correct but when I worked in the central criminal court my boss told me something along those lines.

Also, the crazy cloaks with the weird inside out pockets were to allow the barristers to take the cash from their clients without touching their filthy diseased hands.

Lol...I actually had a real Larry David moment once when I was working there. I bumped into a guy I knew that I hadn't seen in years and got chatting - the usual mindless chit chat. Without thinking I foolishly asked if he was working there in the four courts to which he just replied "no"...I knew as soon as I had asked him that I shouldn't have, turns out his brother was on trial for something and he was in for the trial.

There was an awkward silence after that I can tell you!
