What does everyone think of this story?

Summary: A 62 year old Texan was acquitted on shooting charges from a neighbor's burglary. He witnessed two men crawling out of a neighbor's house (the neighbor was out of town). He called police, then went outside and shot both in the back.
While I think he probably got rid of two pieces of trash - I think he should have been charged. I don't know how they can seriously argue that he was threatened when he went outside against the advice of the 911 operator he was talking to. In addition, he shot them both in the back.
When I was 14 or so I was walking in the woods and some old fart threatened to shoot me. All I was doing was walking in the woods... this guy in this situation may have been right, but an old guy is liable to see a crime happening in a lot of situations where there isn't. I bet this guy was just waiting for the day he could shoot someone and feel justified.
