i still think the evil guy would find it in himself to say that his hat was infact green and set them all free.

Yeah, C for reasons stated above. However, this riddle works better if you tell it from the point of view that YOU are C. Thus: YOU are buried with your head sticking out of the sand, one of your friends is in front of you wearing a green hat, you know one of your friends is behind you, and you know your last friend is behind the brick wall. To the OP... I am guessing that you forgot to say something VERY important. You didn't say that the 4 people knew that there were only TWO colors. You also failed to say that A,B,C and D knew there were 2 red and 2 green hats, even though it was shown in the pic. How did A,B,C,D not know that there may have been 3 green and 1 red for example. With this vital info left out the puzzle has no solution. Sorry. You fail.
