Actually it depends largely on two things:
1) If the file contains copyrighted material
2) Local legislation.
In general, anything that contains copyrighted material, in any form, requires the permission of the copyright holder. And usually a fee is charged "pr usage", if permission is given. However, in many cases, the fee is waived if there is no commercial gain.
Local legislation may vary. Some contries have no respect for copyrights, some countries charge exorbitant fees for copies, some have rules for fair use and similarly.
However, in general, when talking files, it's always a good idea to ASK for permission from the copyright holder. If you are unaware of who has the copyright, try to contact the publisher, or the place you got the file. If you get no response, you can try putting the file up, and simply put a "disclaimer" on your site something like: "files may contain copyrighted material, which is the property of its respective owners. If you hold the copyright to any of the material on this site, be aware that it has been published for non comerical use only, and that I'm willing to remove any of your material once proof of your copyright has been established." It's quite common to see if you run around in the "abandonware" section of the net. Normally, noone will sue you over anything if you can show that no malous was intended, and noone got rich, hurt or in trouble over your usage.
If you want to be absolutely sure, find out what local law says.. it's never the same around the world.
