Context and common sense I think. A derisive "amigo" can probably be taken as an insult. Stumbling through a "gracias" at a greasy burrito joint probably won't be thought much of. Familiarity with the person probably helps, and being sure that they can speak the language before you blunder into it. It's been my experience that second-language English speakers are usually delighted when you attempt their first tongue, even comically poorly, and will offer feedback or advice.
