The Investor-State Dispute Settlement is in NAFT and has been used.

the way it's set up is fucking stupid. there's a reason why similar laws were never implemented in domestic legislature.
This isn't the first multinational trade agreement whereby companies can supercede national laws in the name of business. These deals pass (and this one will too) because capital interests are embedded in international politics. It's been a while so I can't remember exact case studies but I remember one legal dispute about the use of pesticides in Mexico by a multinational. Can't remember the details or what trade agreement it was under. More of the same - it gets talked about in the media and then passes and everyone forgets about it until the next time.

That's the major clause that has people up in arms. The way the dispute resolution is set up is quite concerning, especially in terms of respects to national sovereignty.KEN-JENNINGS wrote:

It's just a clause for companies to bypass WTO arbitration and directly sue governments so they don't have to do this:

I'm all for free trade agreements, it's just certain ways they are set up that becomes an issue.
Copyright clause is also another one of concern.
