(Article 31, (1))
Note the word "directly".
So: They have the choice, they can enter a country illegally if its the first country they come to, or they can present at a border or embassy of a second country if they wish.
Entering a country illegally by an indirect route is not allowed.
Also "life or freedom". Being unhappy about living in a third world country, however shitty, and and wanting to live in a first world country doesn't cut it.
