And Apple is the one who started the legal battles. They're suing basically every capacitive touch screen smartphone manufacture that exists.
revenue being up doesn't mean anything because the entire smart-phone market is growing... i'd be surprised if any smartphone company had revenue that decreased. how is that retarded? legal battles are petty attempts to squabble over proprietorship or settlements because you can't compete out of the courts. imho.

android is a platform, though, not a phone. it's a bit misleading to say "android has a larger market-share" because it doesn't actually identify any single brand/model of phone that is really dominating. the iphone is still far and above the most popular smartphone, and i don't think there's any way you can really present that fact any differently.

you have to be specific in what you're talking about... and you're not. it is not misleading, no, to say that windows has the largest marketshare for operating systems and platforms. does windows have the largest marketshare of computer brands? no, because windows do not make computers -- in this regard apple compete with dell, hp, sony, etc. not microsoft. similarly, saying "the us iphone is only 8% ahead of RIM" is another massive lol comment, in the exact same vein as your original android comment. RIM produce many, many phone models. apple produce 3. compare phone model to phone model, as i said, and the iphone is still far and above the most popular smartphone choice. RIM is probably the closest comparison to Apple I can think of. They both make one line of phone, the iPhone and the Blackberry. iPhone has 4 or 5 models now, do they not? Blackberry has been around a significantly longer time in the phone market and have only the Curve, Bold and Torch modles still available for sale (as far as I remember).
You can't group all the iPhones in one grouping and then separate each individual line of the same company, that's ridiculous. The iPhone 4 may be the most popular choice for new phones, but its certainly not far and above the others (especially not here in Canada)

so you say you can only still buy 3 blackberry models but then say there are 4 or 5 iphone models available? what is it with you and producing statistics or 'facts' that are either terribly skewed or just plain misrepresented? you can buy 2 models of iphone in the store right now: an old 3gs or a 4g. soon (as rumours have it, anyway) you will be able to buy an old 3gs on write-off prices, an old 4g and the new 4gs/5g. so even if you are comparing straight iphones to RIM, you are currently facing 3 models (i remember many more in the recent past... i can get at least 4/5 blackberrys at my local supermarket...) to 2 iphones. your move.
