She was cycling on the pavement, under the supervision of her mother, and killed someone.

Her mother is also being sued, legally they probably both need to be sued at least to begin with.
I was involved in a broadly similar case and it all hinges on the relevant law.

Judges don't do anything other than apply the law is it is - at least usually.
If a lawyer doesn't bring in enough law to make a case then that lawyer loses.

Someone definitely needs to be held responsible. Not necessarily the kid, but the parents definitely.

I thought there was a law against stuff like this (suing someone under a certain age) here. Guess not.

So what would the settlement be? a copy of Playschool magazine and a chocolate bar?

This seems ridiculous to me in it's entirety. The kids knocked the old lady over, and broke her hip. Yeah that sucks for the old lady, but a big bunch of flowers and an apology should suffice. Shit happens, after all. It's not a matter to sue for. If anything, they should press charges for ABH, and see how fast that shit gets laughed out of court.

EDIT:
The lawsuit started before the Ms Menagh died. It was merely carried on by her son as Executor.
