Quick question, a friend of mine rented a house through an agency, they are French. The deposit was £150 which she paid to the agency, the agency was then meant to pass the deposit on to the landlord.
She is leaving England soon and so the house rent is over. When she tried to get the deposit back, the landlord said the agency never gave it to him, the agency are saying they did and can't help her.

Where does she stand on this? What can she do?

When you rent a house the letting agency should put the deposit in a tenancy deposit scheme so what you just described doesn't happen.

After taking the deposit the landlord / letting agency should have given your friend the information about what scheme they used, so they don't just pocket it.

I may be wrong, but that's how it worked for me.

Yeah and should do within a couple of weeks of receiving the deposit.

does your friend have any documents stating about the transaction of the agency taking the deposit and then giving the deposit to the landlord

and paperwork on the deposit that your friend gave to the agency

Ok she has the receipt of the deposit transaction between her and agency, the agency claims they have proof of trans between them and landlord

make sure your friend doesn't play middleman in this either ..... get him/her to get the landlord on the phone 3-way style, so they can hear it from the agencys mouth that they have proof on the deposit

Well the agency has closed today, she said that they said they have proof, but didn't actually show her. From what i can gather from these websites, it's up to the landlord rather than the agency, even if he claims that they never gave it him

Just go up the ladder tbh.
Once you see the letting agency's proof of giving the money to the landlord then ask him where your money is.
If the agency has no proof ask them where your money is.
