Can he even do this without congressional approval?  Is this another of those presidential orders or where he "deems" it possible?

Can a judge block this like how a judge blocked the moratorium on off-short drilling recently?  Is this an example of the Executive branch usurping the other branches?

I know it's fox, but if they're reporting it then usually something is up.  Whether they're going to blow it out of proportion or spin it to hell is another matter, but they have some evidence that something is going on.
