The 8,000-square-foot mansion was dark and in foreclosure for years. So last weekend when the for-sale signs came down and the lights lit up, neighbors were relieved.  “We were like — ‘finally, somebody’s going to make that place a home,’ ” says one.  But then some new signs went up.

“No trespassing,” the signs say. “Privately owned property. Not for sale.”

That’s odd, neighbors thought. The West of Market neighborhood in Kirkland is friendly, easygoing. So one of them called the real-estate agent to ask what was up.  What he said floored them. The house is still for sale for $3.3 million. Whoever is living there had broken in. They’re squatters.

“It’s blown everybody away around here,” said another neighbor, who asked me not to print her name.  “It takes some real guts to just waltz into a house like that, I’ll give them that.”

We were standing across the street from the six-bedroom, six-and-a-half bath house, dubbed in the ads as “Mediterranean Natural.” With its rock exterior and terraces, it looks like a miniature hotel.

“Elevator to the theater, wine cellar & tasting room, game room, recreation room, nanny’s quarters, den/library, culinary artist’s kitchen, bonus room and the lavish master suite & bath,” reads a listing from 2008, when the house was for sale for $5.8 million.

If you’re going to squat, might as well do it in style.

Kirkland police say it’s true — someone just showed up and changed the locks a week ago. They now claim they own the place. Police don’t believe that, but also don’t tend to get involved in landownership disputes and so haven’t done anything, yet, to remove them.

Wow...just wow.  Isn't trespassing against the law?  Completely brazin and illegal, but I guess if the police won't enforce the law there are no consequences.

They need a search warrant and probable cause. They can't just waltz into the house and kick whoever is inside out. Should cops be allowed to walk around asking every homeowner to produce proof of ownership or be forcibly evicted? No. The owners of the house will have to go through the proper channels and then it will be worked out. Might take a while but it's the way the justice system is supposed to work.

Update: Grand Theft: House

Looks like there's an up-tick in "property theft targeting bank-owned properties,” according to the FBI.

Scammers are getting their game on by making them sound like Robin Hood types helping the little guy against the big bad Sheriff Banks.

Meanwhile the owner prays that the squatters don't do any permanent damage.

You don't have squatting laws?

Some friends and I used to squat places back when I was in my late teens. We had a nice big mansion in Blackheath.

Stick a few section 6 notices up round the place - I think if you squat somewhere for 12 years or more it becomes yours.

LEGAL WARNING

Section 6 Criminal Law Act 1977
As amended by Criminal Justice and Public Order Act 1994
TAKE NOTICE

THAT we live in this property, it is our home and we intend to stay here.

THAT at all times there is at least one person in this property.

THAT any entry or attempt to enter into this property without our permission is a criminal offence as any one of us who is in physical possession is opposed to entry without our permission.

THAT if you attempt to enter by violence or by threatening violence we will prosecute you. You may receive a sentence of up to six months imprisonment and/or a fine of up to £5,000.

THAT if you want to get us out you will have to issue a claim in the County Court or in the High Court, or produce to us a written statement or certificate in terms of S.12A Criminal Law Act, 1977 (as inserted by Criminal Justice and Public Order Act, 1994).

THAT it is an offence under S.12A (8) Criminal Law Act 1977 (as amended) to knowingly make a false statement to obtain a written statement for the purposes of S. 12A. A person guilty of such an offence may receive a sentence of up to six months imprisonment and/or a fine of up to £5,000.

    Signed

    The Occupiers

N.B. Signing this Legal warning is optional. It is equally valid whether or not it is signed.
With the mansion in Blackheath, property developers ended up handing over loads of cash so everyone left and they didn't have an awkward legal battle.

heh, I know exactly where that house is. Been watching this story for a while now. If they were my new neighbors, they would be entering a very hostile environment.

Also, in Washington State, if your neighbor builds a fence on your property and you don't take it down, after 6 months, that land becomes theres. Some stupid laws around here.

How quickly you've moved from get rich quick schemes to full blown thievery. Interesting.

Well, you certainly have more free income if you don't pay for legitimate housing!

Easy solution, I'm the real-estate agent and I never sold the property, I do have some potential buyers and they want to see the house today.. guess what.. strangers in the house.. call the cops.

"Antonio Vurro owned an empty rental home in Sunrise, Fla., that he was trying to sell when he discovered in February that someone had moved in, changed the locks and was trying to open a utility account.

"There were boxes all over the place and a mattress in each room," Vurro said in a recent interview. "This is not right. It's my house."

The occupant, Fitzroy Ellis, told Vurro he was entitled to take over the home because it was abandoned. Police disagreed, and Ellis, 64, is now in the Broward County Jail charged with six counts of grand theft.

Ellis tried to claim a total of 48 properties in Broward, including a $1 million house in Coral Springs, through a company he formed called Helping Hands Properties Inc., county official records show. He told a Plantation, Fla., police detective he planned to rent out the houses and condos and could offer tenants a good price "since he didn't have to pay anything for the homes," according to a police report."

There was another case where the man tried renting out foreclosed properties on his street here in FL (with no legal right).. but I cant find it right now.
