You can't say the circumstances so can't say whether it's rape or not. They could've touched her, kissed her, actually had sex -- we don't know because the article doesn't say (probably for legal reasons).

I fail to see how I am jumping to conclusions by saying that the term 'rape' wouldn't have been used in this article twenty years ago. Perhaps you could explain it?

No, I know precisely the same about this case as is reported. What I'm saying is that what's reported would never have been referred to as 'rape'. It's pretty obvious.
