Police tried for hours Monday to contact a teenager believed to be holed up in a Dart­mouth apartment with a handgun.

But when they broke down the door, they found no one inside.

“They were just clearing the apartment while at the same time the youth in ques­tion actually contacted his parents and ad­vised that he was at another location," Theresa Rath, spokeswoman for Halifax Regional Police, said Monday night.

“Officers made arrangements to go meet him on Caledonia Road and he is in custo­dy. " Police were called to the eight-level apartment building at the end of Churchill Court, a small cul-de-sac off Roleika Drive, at 3:50 p.m.

A woman, described only as a family friend, called police to say she had gone to an apartment on the fifth floor and seen a 16-year-old boy with a handgun. Officers arrived and soon called in the emergency response team and crisis negotiators to try to speak with the teenager. They also be­gan evacuating nearby apartments on the fifth floor and those directly above and be­low the unit.

Daniel Lepage and Shannon Davidson share a balcony with the apartment police had surrounded. The only thing that sep­arates them from the other side of the bal­cony is “a little wall you could hop right over," Lepage said.

They said they heard nothing before po­lice showed up at their door.

“They just asked us how many people were inside, told us they had a situation next door and they just asked us to go downstairs," Lepage said.

The pair waited on the street in a friend’s car, watching with the hordes of people who had come to see why almost a dozen police vehicles were around the building.

“This is definitely out of the ordinary. Even for Churchill," Lepage said.

Early in the evening, Rath said, police “actually witnessed the youth in question on the balcony of (the) apartment," and they also had “information to suggest it was him on (the) balcony. He did go back in­side the apartment."

But officers received conflicting infor­mation — some people told them he was still in the apartment and others said he was long gone.

Officers entered the apartment at 7:45 p.m. and found a pellet gun, which in­vestigators believe is the gun the woman spotted when she came to the door.

At 7:50 p.m., the boy called his parents on their cellphone, Rath said. Minutes later, a man and a woman, believed to be the boy’s parents, walked out of the building’s front doors with officers to a waiting police vehi­cle and were driven away.

“He was fearing meeting police, but we went with his parents and police officers" to an undisclosed location on Caledonia Road where the boy was arrested, Rath said.

It turns out that the pellet gun “was nev­er used in a threatening manner," Rath said. But, she said, “the woman did fear for her safety. She felt that it was a handgun" and she called police.

The boy was released shortly after 9 p.m. without charges. Rath said his parents re­linquished the pellet gun to police for de­str uction.

Police don’t know why the teen waited so long to tell his parents where he was.

“We wish he’d done it sooner because it would’ve allowed us to clear this up a lot sooner," Rath said. “But we’re just glad it has ended peacefully."

There have been LOTS of questions, in the Courts, about airsoft and even paintball markers.
Remember, I had a visit from the ETF for cleaning a paintball marker (WPG type) in my back yard.

Section 84
"prohibited device'' means :
(e) a replica firearm;
"prohibited firearm'' means:
(d) any firearm that is prescribed to be a prohibited firearm;
"prohibited weapon'' means:
(b) any weapon, other than a firearm, that is prescribed to be a prohibited weapon;

"replica firearm'' means any device that is designed or intended to exactly resemble, or to resemble with near precision, a firearm, and that itself is not a firearm, but does not include any such device that is designed or intended to exactly resemble, or to resemble with near precision, an antique firearm;


Now, heres where it gets a little strange.

Section 91 Unauthorized possession of prohibited weapon or restricted weapon.

(2) Subject to subsection (4) and section 98, every person commits an offence who possesses a prohibited weapon, a restricted weapon, a prohibited device, other than a replica firearm, or any prohibited ammunition, unless the person is the holder of a licence under which the person may possess it.

Thats why it's in the Courts.

And just to drive the Yanks nuts.... lest have a look at:

Section 117.11 Onus on the accused:
  Where, in any proceedings for an offence under any of sections 89, 90, 91, 93, 97, 101, 104 and 105, any question arises as to whether a person is the holder of an authorization, a licence or a registration certificate, the onus is on the accused to prove that the person is the holder of the authorization, licence or registration certificate.

So, should you have a problem with a question of you being authorized to have a gun...... YOU have to prove it on demand or.......BUSTED.
