WASHINGTON (AP) - The House voted Thursday to make it a federal crime to assault people because of their sexual orientation, significantly expanding the hate crimes law enacted in the days after Martin Luther King Jr.'s assassination in 1968.

With expected passage by the Senate, federal prosecutors will for the first time be able to intervene in cases of violence perpetrated against gays.

Civil rights groups and their Democratic allies have been trying for more than a decade to broaden the reach of hate crimes law. This time it appears they will succeed. The measure is attached to a must-pass $680 billion defense policy bill and President Barack Obama - unlike President George W. Bush - is a strong supporter. The House passed the defense bill 281-146, with 15 Democrats and 131 Republicans in opposition.

"It's a very exciting day for us here in the Capitol," said House Speaker Nancy Pelosi, D-Calif., saying hate crimes legislation was on her agenda when she first entered Congress 22 years ago

I can understand hate crimes being classed as those which are racially motivated, anything other than that though can be too ambiguous.

I can understand hate crimes being classed as those which are racially motivated, anything other than that though can be too ambiguous.

However proving racial motovation is the problem, The classic example is 2 white guys beating down a black guy. It can't just be "racial" Wouoldn't Rival gangs killing each other off or handing out beat downs be a Hate chrime since they obviously hate each other since they live 20 blocks in opposite directions or doesn't it count because they have the same skin color?

But its not hard to prove a skinhead beating up some 12 year old black kids was racially motivated.

If it can be proven, then charge them with it. If not it's just an assault case.

I wouldn't be surprised that they will write the law that automatically characterizes a crime a 'hate crime' if the victim is gay.

Thinking about it now, I have to say who gives a fuck if someone really gets charged more for a crime.

I'm not going to go out and attack somebody over just about anything so the idea of me running the risk of being charged with a hate crime is silly.

Now most of the people who commit "hate crimes" did pull off some sort of violent act, an extra few months or years on top of their sentence is really of no great concern of mine.

Ideally I would like for the punishments in general to be harsher and to do away with the hate crime laws in general, but "You gotta work with what you got".

That said, much as I hate to agree with Macbeth, I'm not sure there's a lot of point in punishing people more because it's a 'hate crime'. Can anyone give me a good reason for why we should have it?

I think it's supposed to cut down on 'hate' although frankly if you have that much blind fury toward someone because of their race/sexual orientation/religion/whatever then I doubt that being charged with a hate crime bugs them.
