Technically he could. He had the necessary intent, that death is a virtual certainty, and the act of committing murder will eventually occur because she will die.
If you call a 0.2% chance a virtual certainty.

That is (roughly speaking) the chance of catching HIV from an infected partner through a single act of heterosexual intercourse....

Which is why I think classing this as murder is wrong. Manslaughter would be fine, but for murder you need to establish intent and I don't think they could for a case like this. I think his intent was to get laid, not to kill them - but I don't know the details.
Hold on are you saying there is 0.2% chance of getting HIV from someone infected with AIDs ?? Where did you get that from ?
American Medical Association.

I just went to a funeral on Saturday for a friend of mine from High School. He had aids from sharing needles. He also gave it to another friend of mine who will be gone soon too. The thing is, the second guy new the first guy had aids and still shared a needle with him. Would that be considered murder if the person knowingly contracted it? Pisses me off just thinking about that shiat. Fuck needles. Fuck aids.

Indeed.

The Germans clearly don't class it as murder:
Under German law anyone convicted of knowingly infecting another person with HIV faces a prison sentence of between six months and 10 years for grievous bodily harm. If the victim dies the sentence rises to a minimum five years' imprisonment and a maximum of life imprisonment for manslaughter.
You can usually rely on the Germans to look at these things logically.

Indeed...  Death by flamethrower would be most appropriate.
