No this isn't a thread about those salty seadogs operating out of idyllic Somalia - the verdict is out: those who run 'The Pirate Bay' file sharing website have been found guilty of breaking copyright law by the Swedish courts and must now pay colossal damages to various media corporations. So what do you reckon - fair? Unfair? Are they facilitating crime? Should they not be held responsible for the actions of others? Answers on a postcard.

Totally depends on the law in Sweden, if it's illegal to faciltate crime then a lot of companies should be up on charges. Which is why such a law is rediculous. Any business can faciltate crime, it's whether they are knowingly and purposely doing it. You can't prove such a charge against Pirate Bay though, they simple provide a service to download binary's that other people have made. The content linked to those binary's might be illegal but it just as equally might not be.

Maybe they should be fined but not a huge amount. They aren't personally breaking copywrite and shouldn't be held responsible for other people that are.

This decision will be appealed. The verdict doesn't mean all too much right now.

Quick somebody charge the Swedish government with facilitating the following...

Taxation fraud.

Welfare fraud.

Theft of prescription drugs.

Corruption.

Etc. etc. etc. What, they did make those crimes possible by giving people taxes to dodge and such.
Whoa... Can't believe these forums are still kicking.

With that logic, we should jail mothers for giving birth to potential Hitlers.

Think of it more like Jailing prescription drug dealers who know full well that the people that they are giving these drugs to are abusing them but they still give it to them anyway.

Does this mean I should probably stop using TPB? Anyway, I thought they had a pretty much airtight case and the Swedish government couldn't touch them?

Well in comparrison they created the website at their own expense, and continued to run it knowing about the copyright infringements and all that. Tax, welfare etc can be attributed to the fact of lifestyle, where they're forced into it due to financial issues, whereas this is totally different.

Yet I do agree that the damages claim is harsh and that.... I mean, if you looked at every single computer, I can bet you that 9/10 computers will have some illegally downloaded stuff on it.... shitsux tbh.

They were more like librarians though kustav. They never hosted pirated or copyright material. Only a catalogue of what was available for download.

They could have been providing links to shareware and freeware files for all they know.

They were effectively a search engine... you can find torrents using Google. Are Google going to be thrown in prison?

On a fundamental level I guess it boils down to whether or not you think it should be illegal to hook one computer up to another.

So Microsoft should be sued next then, by the logic, I mean if we didn't have windows we wouldn't be able to do any of this.

Ladies and gentlemen, we are reaching the end of an era. The era where the internet was a haven for us people who don't have shitloads a money. A place where we all united and became one. We shared, we enjoyed the movies, we loved the music and we had a hell of a lot of fun. Without authorities really giving a damn.

I tell you. This is the end of the world. Once the internet starts getting monitored and banned, I am leaving this world. It's going to end badly. Really badly.

The following was written shortly after my arrest...

                       \/\The Conscience of a Hacker/\/

                                      by

Another one got caught today, it's all over the papers.  "Teenager
Arrested in Computer Crime Scandal", "Hacker Arrested after Bank Tampering"...
        Damn kids.  They're all alike.

But did you, in your three-piece psychology and 1950's technobrain,
ever take a look behind the eyes of the hacker?  Did you ever wonder what
made him tick, what forces shaped him, what may have molded him?
I am a hacker, enter my world...
Mine is a world that begins with school... I'm smarter than most of
the other kids, this crap they teach us bores me...
        Damn underachiever.  They're all alike.

I'm in junior high or high school.  I've listened to teachers explain
for the fifteenth time how to reduce a fraction.  I understand it.  "No, Ms.
Smith, I didn't show my work.  I did it in my head..."
Damn kid.  Probably copied it.  They're all alike.

I made a discovery today.  I found a computer.  Wait a second, this is
cool.  It does what I want it to.  If it makes a mistake, it's because I
screwed it up.  Not because it doesn't like me...
                Or feels threatened by me...
Or thinks I'm a smart ass...
Or doesn't like teaching and shouldn't be here...
Damn kid.  All he does is play games.  They're all alike.

And then it happened... a door opened to a world... rushing through
the phone line like heroin through an addict's veins, an electronic pulse is
sent out, a refuge from the day-to-day incompetencies is sought... a board is
found.
"This is it... this is where I belong..."
I know everyone here... even if I've never met them, never talked to
them, may never hear from them again... I know you all...
Damn kid.  Tying up the phone line again.  They're all alike...

You bet your ass we're all alike... we've been spoon-fed baby food at
school when we hungered for steak... the bits of meat that you did let slip
through were pre-chewed and tasteless.  We've been dominated by sadists, or
ignored by the apathetic.  The few that had something to teach found us will-
ing pupils, but those few are like drops of water in the desert.

This is our world now... the world of the electron and the switch, the
beauty of the baud.  We make use of a service already existing without paying
for what could be dirt-cheap if it wasn't run by profiteering gluttons, and
you call us criminals.  We explore... and you call us criminals.  We seek
after knowledge... and you call us criminals.  We exist without skin color,
without nationality, without religious bias... and you call us criminals.
You build atomic bombs, you wage wars, you murder, cheat, and lie to us
and try to make us believe it's for our own good, yet we're the criminals.

Yes, I am a criminal.  My crime is that of curiosity.  My crime is
that of judging people by what they say and think, not what they look like.
My crime is that of outsmarting you, something that you will never forgive me
for.

I am a hacker, and this is my manifesto.  You may stop this individual,
but you can't stop us all... after all, we're all alike.

not 100% free, but I'll assume they'll find out that they can never ever beat piracy.

So, the people who earn money from piracy are the ISPs, yes? So, if they co-operated with the ISPs and add an anual fee to the internet subscription, downloading music could be free. So if everyone added ~$30 pr year (or even $20, not sure what the exact numbers are), you could make downloading music free, count how many users download from each artist and distribute the money accordingly.

But yeah, this is rather far fetched, so lez say 40 years then.
