An Ohio couple
has filed a lawsuit saying school officials failed to stop bullying that they claim led to their 17-year-old son's suicide.

The suit was filed in federal court last week, almost two years to the day when 17-year-old Eric Mohat shot himself in the head. Parents William and Janis Mohat say their son was taunted and harassed by classmates at Mentor High School for months before his death on March 27, 2007.

Their lawsuit accuses the school district about 25 miles northwest of Cleveland, of violating the high school junior's civil right to safety.

The teen's father says they would drop the suit if the school system adopted tougher regulations on bullying.

You have to be reasonable when placing a contractual or professional duty of care over students during schoolhours. There have certainly been a lot of cases (minor and severe) in the English legal systems in which school teachers and other professionals have been held liable for accidents or acts that have taken place under their care or on their school grounds.

Establishing this as an example of negligence (to English law definitions, at least) will be an interesting case to watch. I'm sure with the right lawyers this family can stand to get some form of compensation or closure to the tragedy. Definitely not a certain though, the school could just as capably put forward a rationally-standing defense.

yeah but they are saying they wont go with it if school system adopted tougher regulations on bullying. So wouldn't it be more logical to just adopt a new system.

More entitlement, Did these parents speak to the parents of the bully? DId they speak to the bully himself. what did these parents do to help their son gain the confidence he needed to deal with a bully. If they are like most parents, they dropped their kid off at school ( babysitting) and forgot about him. Their kid had a confidence problem, and a self worth problem that the parents never addressed, so now it is the schools fault. Go figure.

1. Talking to the parents of he bully wont do anything, 99% the parents are trash which is why the kids acts out.
2. Talking to the kid will only make things worse because they will take it out on the child later on embarrass the child more and further kill confidence.
3. Even if the kid had confidence problems there is still no reason he should be bullied at school. You are there to get an education to better yourself not be bullied by some stupid ass kids.

Nope, my kids go to public school, my kids are taught to stand up for themselves. In fact, I have already had conversations with them regarding bullying. My answer for them was simple. Stand up for yourself and do not let anyone push you around. Even if it meant getting in a fight and being suspended. I told them if they stood up for themselves and got suspended, I would take them on a vacation for the duration of their suspension as a REWARD for having enough self respect to stand up to bullies.

Rules are already in place. I know of no school that permits perscution of students by other sudents. The fact is the school is there to teach, as you have said, they are not referees nor police. Deal with your own problems.

Always was simple and worked for other things there are other ways to hurt people also. That method is extreme though.

I can see the frustration. Schools have a zero tolerance attitude toward fighting these days but have always completely ignored bullying. It makes a kid feel helpless.

If they can show that the kid who commited suicide seeked help on multiple occasions and was ignored then I hope the parents win.

3. lol anyone I had problems with, I generally avoided fights, I wouldn't let it get to that point. Um do you really think this is the way I act, things I talk about or way I talk in real life? I don't, nobody suspect anything because I was careful always kept my misdeeds to myself. Here nobody knows me so I can be completely honest.
