Herein lies the problem with decriminalization + taxing, you need to hope that people will be lazy enough to buy from you instead of growing it themselves, but that's a problem if they already do so. You'd need to have even worse penalties from growing/distribution in decriminalized land than you have now in order to push some of the growers out of the market so that people will actually buy it legal and pay the taxes.
