I've seen this point raised numerous times, about the fact that the Supreme Court will likely have two or three new replacements for whoever is elected to select. Those leaving would be the two moderate liberal judges, Ginsberg and Souter. McCain, with his newfound neoconservatism (i.e. standard GOP beliefs/alignment), and demonstrated poor judgement, would nominate more conservative judges, which would allow for the conservatives to push their agenda (as they already have started doing). Obama would not place the court in such an unbalanced state. Naturally, the country does not want one bloc to control the Supreme Court. Although I may be a bit biased (read: am) towards Obama, I truly think this is a concern for people. Conservatives, just like the "liberal activist judges" they decry, seem willing to legislate from the bench. That isn't the nature of the judiciary, and I think voting for Obama to prevent a conservative-dominated court is a completely valid reason. Do other people share this belief, or have other insights on the issue?
Wait, are you voting for Obama for Obama or for Supreme Court replacements, because the latter isn't much of a vote of confidence.
I can't vote sadly, and mine wouldn't make a difference considering Oregon's solid Democratic lean, but both. I find the latter an extremely compelling reason to vote for Obama, or at least to vote against McCain. I know its not necessarily a vote of confidence, but if you are picking between two failures, one of which is guaranteed to become president, you want to pick the one that is less of a failure. McCain is much worse than Obama when looking at this aspect.
Haven't heard either candidate say much about their criteria for selecting SCOTUS judges. Without knowing their selection criteria, it's hard to say one way or the other who would be better or worse in that regard. Same goes for Cabinet selections...which is just as critical, if not more so, in the near term.
