Basically, a man sues a contractor for failure to provide services that he paid for. Said contractor files for bankruptcy protection. Part of the first part has to repay restitution paid him by party of the second part because party of the second part had filed for bankruptcy protection.

Unfreakinbelievable.

Contractor was convicted in criminal court of first degree larceny and part of his sentence was to pay back the advance he was paid. Convicted and sentenced. In criminal court.

Then the bankruptcy court says the guy he ripped off has to pay back the money that was originally taken from him, plus court costs. Because this guy is now under bankruptcy protection.

I've learned that when you are remodeling your house, you never prepay anything.  You might get billed during the job, but as far as "we require an initial deposit" goes...it indicates the contractor isn't large enough to have cash flow to support his current work....aka risky.
