For some reason everytime I use a transparent background the text come out looking like shit(see sig below). Obviously I have set it to smooth in photoshop so is there somthing i am missing?

Try without stroke, I think that's causing it, or make the stroke smaller.

Grab the blurr tool and soften up the edges. That normally happens.
I usually crank up the size to: "ridiculous", then resize to normal.

You can't do this smoothly when using GIFs. Either you eyedrop the background color or you use the PNG file format, which supports an 8 bit Alpha Channel, unlike the GIFs 1 bit Alpha.
EDIT: yes doesn't work with IE 6 for example. But either you are using IE 7 or you aren't using IE at all and use Opera or Firefox, which do support PNG transparency properly

I'd say it's anti aliasing or whatever. It's on the options bar at the top when you select the type tool, try setting it to 'Smooth' if it isn't already.
