I have been reading the newspaper about the "terrorists" being kept at Gitmo, and how its "Unconstitutional" for them to be kept there, and that Gitmo should be closed down.
As I understand things, Gitmo is being used as a POW camp, and that the US Constitution doesnt extend to foreign POWs.
Am I right and should the Constitution have no jurisdiction at Gitmo? (only the UN Charter of Human Rights and POW treatment).
It just seems to me to be REALLY hipocritcal (and dangerous) of the US Govt. to start thinking that these people that wish to do harm to your country, can be afforded the same rights and privilages as the common US citizen.
If I was part of the whole Gitmo thing and had a say about which suspect goes where, I wouldnt even START to think that they had the same rights as average Joe US Citizen.

How can you logically argue that Americans have more rights than anyone else?  Further, they have yet to be proven to be a threat to the US, or to be wishing the US ill, in any form of court or review.

I think the Geneva Convention should only apply if both sides follow by it. So go Gitmo.

alot of people do gloss over the whole waiving your GC rights by not following it's guidelines thing

but as for as the USC goes, ummmm, US rights for US citizens, Aus rights for Aus citizens, uk rights for uk citizens, you get the picture

If you're big enough you can do whatever you want.

The UN can send the president a sharp note and "demand" that the US cease with the "Non-combatant" mumbojumbo but can do little more.

On a similar note: (Not sharp. Or flat for that matter... *drum fill*)

If (when) another country/coalition gets big enough to challenge the US about internationally unwanted actions on foreign soil we can only hope that the US graciously backs down or we're all in for a bumpy ride...

But even so, I don't think it's a good thing to throw all moral values out the window because an adversary is using "questionable tactics".

And the problem is that it looks even worse when it's the US who're doing it.
("...and justice for all" and so on and so forth)

The problem I have with people in these forums is they often tell you what you are thinking without having a clue. Sometimes even when you agree with them. That is not only rude but ignorant.

Its unconstitutional. Why? The fecking Nazis who killed millions and were so obviously guilty were given their day in court in Nuremberg. The detainees at Gitmo, or Gito or what ever name Americans who want to soften the subject and put it to the back of their moral consciousness call it, have no evidence that can be used in a trial against them or it would have already been done. Basically most of them are their because someone in the CIA/NSA for some reason marked them as being suspect during the mass hysteria after 9/11. Not a Judge or a jury or any other law maker. An intelligence annalist or tea maker at the pentagon made the decision to take 5 years out of these ppl's lives and that of their children and families. And as now the "Intelligence" community (a contradiction in terms) have been proven as un-intelligent by the many Senate committees and excuses passed by Bush Co. Ie: "wasn't me was the CIA's fault" their oppinions and findings are full of more holes than a 16 year old girl with a pen knife!!
And BTW it was the Allies in WW2 who violated the laws of war by laying Dresden to waste and therefore starting the trend of bombing civilian targets tit for tat. So we are in no position to lecture about the laws of war, even though it was us who wrote them.

How, then, did so many noncombatants end up at Guantanamo?

Many of Guantanamo's prisoners proclaim they're innocent. What's different about these men, Muslims from China's Uighur minority, is that even American authorities said they were innocent, referring to them as "no longer enemy combatants" or "NLEC." Nevertheless, they remained imprisoned more than a year after their names were cleared — after the U.S. government determined they did nothing wrong and posed no terrorist threat to America or Americans.

POW's being so classified does NOT afford them the rights to US courts. Were US prisoners of war, ANY war afforded those rights by ANY country? NOPE.
