Honestly, shouldn't fear of being prosecuted be enough to keep you from dealing illegal drugs? If not, oh well, enjoy your stay. I simply can not bring myself to feel any concern for this woman's plight. I just don't care.

Back to the OP: The sentence does seem quite harsh, particularly if it was a first offense. What wasn't clear was if this was a second, third, or other offense for her. If that were the case, it could explain the longer sentence.

From the local news station (cut and paste of various pieces of the article):

All three first-time felony offenders were booked into the Kingfisher County Jail.

Patricia Spottedcrow pleaded guilty to her crimes as well.

She faced the very same two felony charges as her mother, Dee Starr.

However, Spottedcrow got a 12 year prison sentence, no probation.

She was sentenced to 12 years behind bars for selling two baggies of marijuana worth about $30.

Patricia says, "I've never been arrested. I've never had to spend any time in jail. I knew I was in trouble. I knew what I did. I didn't try to deny it or hide it. But I never thought it would be this."

The judge was Susie Pritchett; a four-term veteran of the bench with a reputation for being tough on crime, particularly tough on drugs.

Pritchett retired a month after she sentenced Patricia Spottedcrow to 12 years.

Pritchett says, "The sentence fit the crime. Ms. Spottedcrow was a drug dealer. Ms. Spottedcrow showed no signs of remorse, nor did she seem to even care about what she was doing to her children."

Judge Pritchett tells us the pre-sentence investigation report played a large role in her opinion that Ms. Spottedcrow would be best rehabilitated by serving time in prison.

Spottedcrow says, "I slept next to this girl here. She's in on manslaughter. She did three years. She was here for a year, and she's gone. I look around at all the people around me. All the things they did. People are here on trafficking two and three times; busted and busted three and four prison sentences and they don't have near as much time as I do."

We uncovered a number of other cases out of Kingfisher County where defendants with prior felony convictions were sentenced to probation or weekends in jail and no prison time.

In fact, one case that went before Judge Pritchett, the wife of a county deputy was busted with marijuana hidden in her underwear.

She was asked to apologize to the judge and never served a day in jail.

Former Judge Pritchett would not confirm or deny that incident but says, "I treat drug users differently than I treated those who pushed drugs, especially when they sold in front of children."
Sounds like a case of judicial activism to me.

Legalization will never happen though, at least not in the foreseeable future.
Decriminalization is a lot more achievable whilst still being a deterrent for the manufacture and sale of drugs.
Mandatory minimum sentences for the common user is just ludicrous.
