In receiving a petition today for the repeal of Section 92A of the Copyright Amendment Act, UnitedFuture leader Peter Dunne pledged to continue fighting to get rid of the clause that will see innocent New Zealanders having their internet disconnected.

A protest campaign against the Copyright Amendment (New Technologies) Act appears to be gaining momentum as protesters, including high profile UK celebrity Stephen Fry, black-out photos on Twitter, Facebook and various other social networking sites.

The Creative Freedom has called Feb 16 to 23 Internet Blackout Week NZ as they seek to protest against the controversial 'Section 92A' due to come into force at the end of February.

Fry, who has thrown his support behind internet Blackout Week, has blacked his out, and now his Twitter site is awash with tweets asking the comedian why.

Central to this, they argue, is getting processing charges removed for lodging copyright infringement notices and, worryingly, giving copyright holders the ability to decide if any disputes to copyright infringement and disconnection notices are valid - effectively making copyright holders both judge and jury.

If alarm bells are going off in your head, you're not alone. Investigating the validity of any copyright infringement claims is likely to be a resource-intensive and costly undertaking for ISPs.

If the various copyright industry groups are exempted from any processing charges associated with lodging a copyright infringement, internet subscribers will probably suffer as ISPs are forced to pass the costs onto internet users' broadband plans.

Oh those poor New Zealanders.

Copyright is very strict here at Uni and you can get into serious trouble with any kind of plagiarism, which is to be expected. I can understand that the uni itself could come under a lot of pressure should plagiarism become the work of any student, but I don't see how the ISP's should be involved in something like this, if at all.

Mr Dunne, UnitedFuture leader... said the clause was actually removed when the Act went through the select committee process last year, but “in the previous Government’s haste to ram through this legislation, the then Associate Commerce Minister Judith Tizard bowed to a small group of lobbyists and reinstated the section despite the fact that it had been removed by the select committee".

The shit will really hit the fan when infringement notices are served against sitting MPs, and parliament. This campaign has enough support that it will happen if the new laws are not removed.

Yes and according to them it was because of the protest/outrage "feedback". They listened.

Because of the feedback we received, we have decided to return to our previous Terms of Use while we resolve the issues that people have raised.

Canada is dealing similar.

Similar to the battles that are being had in Canada, New Zealand seems set to Intoduce similar law as part of "Copyright (New Technologies) Amendment Act 2008" which in effect will require ISP's to terminate your internet connection if you are accused of downloading copyright material.

I've had to strip drm stuff out of my own purchased material before.. just to get it to work on some devices.

A "copyright holder" can get you kicked off an ISP without having to provide any evidence of an actual infringement. Having to [provide evidence] is apparently "impractical" and "ridiculous" in the words of RIANZ chief executive Campbell Smith. What happens when the "you" above is a public library, or a school? Or if the "copyright holder" makes a mistake or a malicious accusation?

Scores and scores of bloggers will be taking part, including Public Address, Scoop, Kiwiblog, The Standard, No Right Turn, Frog Blog, Whale Oil, Not PC, No Minister, Just Left, The Hand Mirror, Roar Prawn, Policy Net, Kiwi Politico etc etc. Supporters of almost every political party are taking part – National, Labour, Greens, ACT, Alliance, and Libertarianz,

To say we represent a diverse range of views is putting it mildly. Normally we disagree on everything. Even e=mc^2 can be regarded as a highly debatable proposition on our blogs.

So for us to all unite together, from across the political spectrum, to condemn S92A of the Copyright Act should send a signal as to how bad the law is. A law which can see people lose their Internet access on the basis of unproven allegations should have no place in the New Zealand statute books.

We don't care who voted for the law in the first place. We just want it stopped. We call on either Parliament to repeal that section or for the Government to delay it from coming into force on 28 February.

The normal content on our blogs will be made inaccessible on Monday morning, and our blogs will refer people to the online petition organized by the Creative Freedom Foundation.

In addition to these political blogs, thousands of other websites including Scoop News, PublicAddress.Net, Throng, GeekZone, and Street Talk are also joining the Internet Blackout.

There are some BIG time bloggers participating in this. It will be interesting to see how serious they really are.
