He may still go on trial.  The OP obviously didn't read the story he linked because it said that he would be held pending new charges - not "going home"

I think the argument for stopping all current proceedings at Gitmo is the fact that some trials aren't "fair" (fair in the US Constitutional sense- Right to a fair trial).  The fact that people have been tortured (going off Crawford's own words) among other indiscretions is enough to raise an air of doubt as to the fairness of the trials.  A complete halt to all proceedings and a revisit of each individual case is in order.

It hasn't been proved, the trial was cancelled and the charges were dropped.

The American judicial system has failed. Simple as that.

Torture, special courts to permit the use of evidence obtained under torture, military appointed lawyers, retrials, all after months if not years of the detainee being held without charge.

You don't have a leg to stand on marine. If he was guilty there is no reason a proper court of law could not convict him.

Exactly, if they had wanted this alleged murderer behind bars they should have followed due process and had him legitimately incarcerated. As it was he was just a guy subjected to irregular, questionable conditions and processed in a manner that lacked transparency, and hence any credible kind of legitimacy, who had to ultimately be released.

Moral of the story... if a guy is guilty then prove it in a court of law with evidence, don't torture him for a confession on a secluded island and operate outside of the accepted rules of civilised society.
