2 dead in city's third justified shooting
One week into the New Year, Alamo City residents or police have already used deadly force to protect themselves or their homes in three separate incidents, resulting in two deaths and two injuries.
The recent shootings follow a year in which Alamo City residents and police killed more than twice as many people in what officials have deemed justified homicides, ones in which the shooter acted within the law.

Tuesday night’s fatal shooting of two suspected home invaders marked the latest example of a resident using deadly force to fend off intruders, authorities said.

“It appears to be a justified shooting,” said Sgt. Gabe Trevino, a San Antonio Police Department spokesman.

Alex Salas, 17, shot two men as the intruders kicked in the front door of his parents’ home in the 100 block of Horace Street, according to a police report.

Michael Garcia, 18, was pronounced dead at the scene. Alexander Lopez, 17, was critically wounded and died around noon Wednesday at University Hospital.

Police said Garcia, a documented gang member who was armed Tuesday, collapsed on a sidewalk outside the near North Side home.

“I don’t think (Garcia) even had a chance to fire (his weapon),” said Police Sgt. John Slaughter.

The resident told police he armed himself after noticing a tan sport utility vehicle circling the neighborhood suspiciously before two men exited the vehicle and kicked in his door. Residents at the home declined to comment Wednesday.

Investigators will try to determine whether Tuesday’s invasion was related to gang activity, Trevino said. Even if it was gang-related, Salas would still be justified because he was protecting his family and property in accordance with Texas law, police said.

“What the suspects are doing there and what involvement they have with the homeowner, we’ll definitely look at it,” Trevino said.

The latest incident followed a year in which San Antonio’s justified homicides more than doubled from seven in 2007 to 17 in 2008. Some of the killings were police-involved shootings. Several homicides were justified under state law, including the so-called “castle doctrine,” which allows property owners to use deadly force to protect homes.

Various law enforcement agencies across the country also have reported an increase in justified homicides. George R. Franks Jr., a criminal justice professor at Stephen F. Austin University, said publicity of high-profile justified shootings has inspired others to take up arms.

“As people see these things happening to folks they identify with, they decide it’s time for them to arm themselves,” he said.

Tuesday night’s shooting occurred a day after a West Side homeowner shot and injured a 15-year-old boy as the teen and his father attempted to break into a residence. The 33-year-old homeowner was not charged in Monday’s shooting.

In a third justified shooting, a San Antonio police officer shot and wounded an armed robbery and carjacking suspect outside a Northwest Side apartment complex after a high-speed chase Friday. According to police, the suspect tried to point a gun at the officer.
I know this is similar to another thread I posted; similar topic, but I thought it might deserve its own thread.  I am glad I live in Texas!

I've heard many years ago that thieves in the United States take a lot longer to 'case the joint' before committing a crime than criminals in other countries like the U.K.

If anything the more news of these types of crimes, hopefully the less likely these times of crimes will be committed because of it being a deterrent (thieves are shitless).

Unfortunately, I think we'll see a rise in home invasions as thieves 'jump the gun'.

I'm glad I live in the United States.

Well, if someone kicked in my door, I would feel a bit threatened!

It would be nice if "hot burgleries" dropped as a result of Castle Doctrine laws, but I have yet to see any real scientific evidence.  (Although the anectdotal evidence makes sense...)

If it became common place, if I was a thief, I would go where it was easier pickings.  I don't know if I would be operating my five-fingered-discount business in Texas...but go to say California or New York and you got easy pickings (Gun laws to keep guns out of the hands of legal citizens FTW).

If I remember correctly (from four years ago when I lived there), home invasion robberies were on the rise in SA. I'm surprised it took this long for this to start happening.

I'll make sure to clean my guns well before I move back there this summer. Would hate to have a misfire.

Save your pennies, buy one as soon as you get out of school.  Less than $500 to get a really decent pistol or shotgun.

I have to review the local gun laws to see what I can and cant have, and how I should store it, but a recent influx of immigrants to the area has noticeably increased the crime rate, so now is certainly a good time to buy one.

The castle doctrine is just like the saying a man is the king of his castle and does not have to retreat when a burglar breaks in. In Texas you can stand your ground and use deadly force to protect your person and your family. Deadly force is also permitted to protect your property at night.

The big changes to the castle doctrine in Texas that the article does not talk about is that in the DA does not have to bring a case to the grand jury where the castle doctrine applies. It used to be that every case where there was a fatal shooting had to go to the grand jury. But In Texas juries are more likely to no bill a case where some dumba$$ gets killed while trying to harm a person in their home. So why bother evening convening a grand jury.

With the bad economy I would bet that home invasions will be on the rise.

Yes, he rather us have them live. So we can feed them, clothe them, and shelter them on taxpayer's money. I hate seeing people on death row for 50 years, I think they shouldn't live longer then one year on death row.

Oh and back on topic, I have a .45 loaded at all times for just that occasion.
