A document unsealed in a lawsuit last week suggests that Microsoft employees knew before putting the Xbox 360 on the market in November 2005 that the video game console could damage game discs.

Several ongoing lawsuits charge that the Xbox 360 is defectively designed because tilting or swiveling the video game console can scratch game discs playing inside.

Plaintiffs in a July 2007 case filed in U.S. District Court in Seattle are seeking class-action status on behalf of all those who purchased Xbox 360s.

Most of the declarations in the court case are sealed, but a newly unsealed motion (read it here) seeking class status quotes from the sealed declarations of Microsoft employees.

The motion says that Microsoft knew that when the Xbox 360 was reoriented with a disc playing inside, the disc could be damaged.

It quotes Hiroo Umeno, a Microsoft program manager, who said in a declaration, "This is ... information that we as a team, optical disc drive team, knew about. When we first discovered the problem in September or October (2005), when we got a first report of disc movement, we knew this is what's causing the problem."

After the Xbox 360 launch, according to the motion, Microsoft sent a team of engineers to stores across the country "to investigate complaints that the Xbox 360 was routinely scratching discs during demonstrations."

Jesus, what are you people doing with your consoles? You wouldn't expect your computer to work if you were shaking it all the hell around, why would you expect to with your consoles.

I do not like Microsoft, but it's not their problem that they didn't design their electronic console to military grade spec.

Seriously, this has happened to me twice now.

Once without me knowing (GTA IV ) SO I guess my brother did some shit to it, and the other day. Just loaded up Guitar Hero 3, ready to play that classic again, and my puppy walks right into my fucking 360, knocking it over.

Now I realise never to stand it up.

Both discs have huge fucking circle scratches all round them.

I love the 360, but this is fucking gay. £80 it's cost me in games, so far.

I'll try repairing them, but if it doesn't work, I'll be bitching to Microsoft and see what they will do for me.

I knocked over my friend's 360 with cod 4 in it within the first week it came out. He could only play like 2 maps so we went to blockbuster, rented cod4 and switched them.

PS3 doesn't do this, as far as I'm concerned.  Strange, I have a friend who has the original XBOX 360 model (Release day version), and it hasn't given him a RROD or any problems, as far as I know.

That is 100% Your problem, if you think moving the console around while a disc is spinning at high speeds is not going to do anything then you have bigger problems than broken discs

Not entirely 100% your problem is it when technology have come pretty far with portable devices, and a console that are made for two positions should honestly be able to be moved while being used ... the PS3 does that and portable CD players have had that for ages now ... it is poor engineering from Microsoft and obviously they know it ...

Not to mention security flaws and such!

Then there is Windows Live Messenger Beta (latest version). What happened to good old light weight programs? This thing takes ages to load up, then when it does load up it then pops up with all the people who have ALREADY signed in! not just the new people signing in, but EVERYONE who has been logged in before I come along. If I close it down to my taskbar then try to open it back up it, it takes ages.

And then we all know how heavy Vista is on computers.

He just did and of course one should ... what's the point of a beta if not for it to be judged so the end product becomes better?

Just what I was thinking. Clearly a rapidly spinning disk being moved around is going to rub on stuff inside and that's going to fuck it up.

I wasn't moving it at "High speeds". It simple fell over about 45 degrees (Onto so other stuff next to it) and I heard the noise then.

They said themselves in Varegg's post they could have stopped it with bits of rubber or some shit (not literally), but they didn't.

That's shit design and failure on Microsoft's part.
