as we all know, EA really doesnt care about anything but money. if thats the case, perhaps taking it away will motivate them.

for those of you will more legal know-how than I, tell me: are we well within our rights to sue EA for releasing substandard games (bf2 &2142), that have or have had major issues with playability in the past (CTDs, server crashes, etc.), that have had major issues with bugs and glitches that potentially ruin gameplay, as well as other malarky?

Well last time I checked trading standards' rules on the return of a product I believe the actual physical object has to be faulty.

So you can't buy a shirt and then take it back because everyone laughs at you when you wear it. But then if the shirt ripped through no fault of your own then you'd be entitled to your money back.

It's an odd one for software, if the actual disk was broken or the product wouldn't install/run (presuming you met the hardware requirements) then you'd be fine to take it back. I doubt you'd even get a lawyer to support a suit against EA, especially with the argument of "EA fucked up and I want my money back".

However I do know a guy who just bitched enough and EA gave him back 3/4 (or maybe it was 1/2) of his money.

At some point someone will (or maybe they already have and I'm just not up to speed) set a precedent, but for now, I unless you wish to go up against a very large team of lawyers, we'll just have to wait.

"I'll never buy an EA product again."

That I've heard everywhere, but most of us do anyway, because EA %#!%! is trolling the video game market.

I have never had a problem with an EA product. Stop clicking on pop-up ads, stop installing porn that ends in .exe, update your drivers, and for fucks sake, run an anti-virus/anti-spyware program. Stop treating your computers like a 14 year old girl who spends all day on myspace and you wont have problems.

@ the thread creator. Are you serious about a class action lawsuit? Do you have any idea how the real world works? "Boo hoo hoo my game crashed. I hate EA LOLOL!!!" There are plenty of shitty games out there buddy, and noone is forcing you to buy them.

everytime i go to rent a movie at blockbuster, i look at the ea games for xbox. most of the time i try to find one and use my free rental on the ea game. then i take it to my house and burn it onto my modified xbox and take it back to blockbuster....thanks EA!!!

about the lawyers.....they would eat you alive. dont doubt for a second that they have some of the nastiest most foul lawyers around. they would say something like the single player works fine, and then counter-sue your ass for your first born.
it pisses me off also, but what are you gonna do.....

We can't sue them because their games suck. Just stop buying them, they'll get the message.

The only way you'll hit them hard is:

A) Drugging their team of lawyers before you go to court

B) Mind-controlling everyone on earth to never buy an EA product

C) Make an obscene amount of money, buy out EA, and "re-work" their management

Im not saying I like all the crashes and stuff but if I were an attorney defending EA I would go on this: The game that was produced by EA that you purchased has no glitches on single player. It is clearly stated on the box that play conditions during online gaming may vary. You have been warned but still chose to purchase the game, at your own risk. Deal with it.

I have never read the whole thing, but the EULA you agreed to when you installed the game probably covers their asses pretty good as far as legality goes. Everyones gaming experience is different, and there is no guarantee that it will be fun. Besides if the EULA doesn't cover it, I'm sure EAs' Law team will.

If you could prove EA, et al, conspired to deliver a knowingly faulty product and somehow cause you to pay more than the original selling price, you may have a case.

Probably the most damage you could cause EA is to inspire people to make mass purchase and refund of an unused product. The costs could be crushing when the release of that information hit the stock market. Whatever damage inflicted, by fines or a stock market dump, needs to exceed the increased development time costs of getting the game right in the first place, to make them listen.

But their revenge might be to buy a Game Console manufacturing company and then stop making PC game versions

not only that, but the consequences of EA spending money on those sharks, instead of spending it on developing, improving (  ) their games, would result in a more expensive games.
Is that what you want, more expensive games?

A: GL getting a lawyer to take this case.

B: If you do, all EA is going to do is drag you through a court battle till your bankrupt.

I've played over 500 hours of BF2 and have enjoyed the majority of them despite the bugs. There are many things in BF2 that I'd like to see changed and improved, but I am not sore for having bought the product. 2142, on the other hand, boldly announced itself as being bad news by forcing demo users to manually download and apply Punkbuster patches from Punkbuster's site so they can play without being kick-banned every three minutes. Once I did that, I was interrupted every couple games or so to be forced to watch a slideshow of generic maps.

There is a remarkable difference in support between the Battlefields of old and BF2+:

For example, in Battlefield Vietnam, we got a couple free maps, and a free Official WWII mod bringing in not only a couple of maps from BF1942, but adding a new one as well. In Battlefield 2, well, we got a $30 expansion pack (which is fine), and two $10 "booster packs" which by justice should have been free (they would've gotten more players, at any rate). Oh, and Jalalabad. Big whoopty.

Question: If EA is so governed by end profits, then why is their support so dismal?
Answer: People still buy their games.

i love how some of you took this to the point of believing i would, or would want to, file such a lawsuit. i'm sixteen for christs sakes. i was just curious, is all, because law is not a subject that is really covered in basic education.

It would be difficult to show that you experienced damage, harm or loss from the game.  Especially if you played it for 300 hours or so.

On the other hand, class action lawsuits can be half law, half public relations. EA would not enjoy seeing an organized effort to publicize the fact that their software is buggy. If you filed a lawsuit and made enough noise in the media, EA might try to shut you up with a settlement.
