C simply has to wait a few seconds to see if D can answer or not.

If D can answer then it is only because the two hats in front of him (B and C) are the same color. If this is the case then D knows for certain that his own hat is the opposite color.

If D has not answered in a few seconds, then C can assume that it is because he is unable to answer accurately. As so, B and C must have two different colored hats.

C then knows that his hat is not the color that B's hat is, and can answer knowing for certain of the color of his own hat.

Well, I was beat. By about 3 pages...crap. Oh well, this one was pretty easy (I've heard it before ).
