The ingame server browser is run by GameSpy. And the way servers get listed onto the list is by GameSpy verrifying that the server that is being hosted, has the EA Ranked Server Contract. If it GameSpy see's that the server has the contract and is an official ranked server, then it is put on the list. If it doesnt pass, it isnt put on the list.
As for the server graphic. That has nothing to do with GameSpy or EA. The server graphic is the same exact thing as viewing an image on the internet. It is just a link that the admin has put to whatever image he wants to the server graphic to be. And in this servers case, this is the link:

So dont blame EA or GameSpy. Blame the guy who is buying this server. And as far as I can see, there is nothing on the BF2 ROE that says you cant have any nudity on the server graphic.
