People seem to be missing the point here. It's most certainly a free speech issue because where do you draw the line? Is everyone aware that if he had written a guide teaching parents how to avoid pedophiles it would've had the exact same result? It just would've been more socially acceptable.
A parent could buy this guide and learn how to protect their children better.
A pedophile could buy a guide dealing with prevention and learn new ways to get through to kids.

That is why I am approaching from a legal point of view. Not philosophically. tbh I find more interesting (we've run the free speech thing into the ground). Right or wrong the Sheriff appears to be a clever man. Getting him to autograph sign it and mail it to the undercover. I mean, just in case there was any doubt in court that he sent it. ..lol

And I completely understand that. You just have to get past the knee jerk "omg this guy is such a piece of shit" thoughts and recognize that info like this is scattered all across the net, in movies, and in other books so trying this guy is nothing more than a way to make people feel better about themselves and safer. It's like the TSA, we all know it doesn't really do shit, but people accept it and put up with it because it makes them feel safer even though they really aren't. I'm also curious how many people (critics of it) have read the book - at least, it would be interesting to see if it has any value for law enforcement/legal prosecution.... or if they're simply reacting to the title (kind of like Andres Serrano's Piss Chirst...)
