You realize directly copying someone's work is copyright infringement just like stealing the work itself? If you're that worried about copyright issues, come up with something new. If not, just use the picture. Do you think someone is really going to take the time, money, and effort, to sue you over a 30kb picture? Worst case scenario you get a cease and desist.
