IMO, student was really being a d-bag, but the teacher overreacted.

A couple years ago, one of my science teachers told the story of how his gym teacher dealt with a similar situation when he was a student.

He cleared the rest of the class out of the room and told the disrespecting student that if he really wanted to behave in that manner, he should hit him right there and then. The student hit him pretty hard, but then the teacher knocked him flat.

IMO that's what the teacher should have done. Could be justified as self-defense.

Hmm, maybe a plea of temporary insanity might reduce his prison sentence, in the light of the comment "it was like watching myself on tv".
The teacher is pretty fucked though, in his position of responsibility he totally lost it.

my politics teacher first started teaching at some dump of an inner city school where someone lit a guy's turban on fire, then when the teacher told him to get out, he threw a chair at the teacher and broke his nose. so then the teacher dragged him to the head teacher's room and HE was suspended for mis treating a student!

btw i didn't read the article before posting that but nothing could be much worse than that

duress or diminished responsibility, depending on whether or not they press forward with murderous intent, or just leave it at GBH. jaekus, you can only plead insanity to a sure-fire charge of murder under english common law; it reduces the charge to manslaughter. nobody died so he doesn't have insanity. lesser defenses for offenses against the person (i.e. ABH/GBH section 18, GBH section 20) exist.

he has a mitigating factor in his defense, at least. but then again... professional capacity, trusted adult-teacher role, children under his responsibility... will be an interesting case. he'll have to make a big defense, and rightfully so. the circumstantial evidence does make it seem as though he had some deep-running mental cause, though.

Oh granted, but if he's at the point where he was laid off for saying he's at the verge of committing violence he should be looking for another job, or at the very least another school. Of course, it's easy to say in hindsight.

the fact this case is now in the media will mean the poor guy probably wont get a fair-trial, anyway.

the judges will fall too heavily on the cause of protecting public interest / satisfying popular-common morality, as opposed to considering it as a symptom of a serious mental illness or state of mind under duress. the fact that we're discussing it on a public internet forum means that justice has been perverted already, sadly.

Wouldn't the case be put forward to a jury? In which case they would be minimised from reading/hearing media speculation and reports on the case?
Slim hope though, man he'll need a damn good lawyer to keep him out of prison.

that was a catholic school, i.e. denominational and/or private

teacher-abuse at private schools is exponentially, considerably higher than it is in the public sector. they're law-makers unto themselves.

You fucked up you got a friday afternoon detention, which lasted from 2:30 - 6.

If you didnt go, you got suspended, and if not, expelled.

An ass kicking is one thing.  Pummeling the kid in the head with a weight that leaves brain damage and could have easily killed him is quite literally...  insane.

I hope the teacher goes to jail for a very long time.
