EBM isn't the one who misheard. EBM was talking to his buddy about getting his shoes shined for his mother's funeral. The black guy interrupts with the typical interpreting everything as racism, and asks why a brother has to spit shine a white man's shoes. EBM thinks the black guy is offering to shine his shoes, and asks how much he charges. Black guy is a racist douchebag, acts all offended even though EBM isn't even remotely racist towards him. EBM removes himself from the bad situation after making a bad joke about it being better to be pissed off than pissed on. Black guy follows EBM, attempts to hit him, gets absolutely wrecked, and tries to ring da ambalamps.

It's amazing anybody can side with the black guy. Did EBM use excessive force? yes. Was he in the wrong? no.

It would of taken a better person to dismiss any remarks made. Either one could of stop at any point before the argument escalated to throwing punches. The end result was one guy with a busted lip and other guy had his bag, wallet, and keys stolen.

Beside the apology to the EBM is weak because he needs to apologize to the old man face to face. Apologizing to a video camera does not wipe the slate clean.
