Prosecutors in Arizona won't file charges against five Mesa police officers for their role in flushing a stillborn fetus down a toilet.

The Maricopa County Attorney's Office determined a crime wasn't committed last month when an officer flushed the 4-inch fetus down a toilet in a motel room.

Sgt. Bryan Soller, president of the state and Mesa chapters of the Fraternal Order of Police, says county officials contacted Mesa police Wednesday to tell them of their decision.

Officers and Mesa fire personnel responded in June to a Motel 6, where they found a woman had miscarried. One of the officers photographed the fetus, which fire officials reportedly declined to take, then flushed it.

So do you think the police should have been charged for disposing of the fetus in such a way out of the whole respect of life thing or do you think their action were justified?

Were the fireman and/or paramedics in possession of hazmat suits?  I think a dead fetus is considered biohazardous material, not sure though.

Surprised they couldn't find a law against it. I'm sure that the charge of improper burial of human remains could have been brought against them.

There are laws against it, but it's such a touchy subject to deal with, plus they were police. I don't think anyone wants to get involved.

Yes it is considered Biohazardous material.

Its not the duty of a Firefighter or a Paramedic to transport a dead body (if you consider a 4inch fetus a dead body, i don't).

It'd be the Coroner's job.

Nothing seems to say. If she was ok with it, then fair enough (aside from the point that flushing hazardous material into the sewers is a bad thing).

Any substance that comes from a human body is considered bio-hazardous.

Blood, Eye Fluid, Baby Batter... Bile..  etc etc.  Its not something you just put rubber gloves on and bob for a 4inch fetus in a toilet.
