Also: while this is clearly pandering to the conservative Christian element of Irish society this law could potentially be hijacked by any other faith that wishes to exploit its power because, to best of my knowledge, there is no specific reference to any religion in particular. Those cartoons of Mohammed would be illegal in this country if this law were fully passed - and that would be thanks to the Catholic church my dear lowing!

Well it's blasphemous libel so it would have to be published in some capacity (I wonder if blogging or micro-blogging counts in that regard!?) but yes, disparaging comments towards God (whoever s/he might be) will no longer to be tolerated in this country. It may very well make it through because the newspaper groups are in favour of the act because of other non-religious amendments to the libel laws that are also included in the act, and hence they are hardly covering the story at all in the press. The Government are also forcing it through parliament at breakneck speed in the hope that no one will notice, if it gets passed this week the Government will then break up for the summer holidays and nothing will be done about it for 11 weeks! The timing is very deliberate and very cynical.

This Government is playing a risky game, people are getting very fucking fed up with them.

I can assure you lowing that our Government doesn't pander to the Muslim community here and as a minority group they certainly don't have much pull within the Government. This is very much a Christianity-inspired move, one that I would imagine was designed to deflect attention from real issues. We have a tendency in this country to get all pious and sentimental over the church when times get tough economically and this appears to be happening again. Just this week we saw a fucking tree stump get 24 hour security protection after people claimed they could see the virgin Mary in it!

Theres a reason why state and church are no longer a single thing. Church was devided from rulling the country for a reason. Now they wanna bring it back? Wtf? I'm really sorry for irish non-believers.

But does the Irish constitution not forbid blasphemy anyway?

It's hardly bringing it back, it's formalising existing rules.

As I see it, this whole thing hinges around the incompatibilities within the Irish constitution and human rights treay obligations. The Irish constitution forbids blasphemy (article 40), but in 1999 the Supreme Court there found that one could not be prosecuted for this since the (very undefined) law only applies to Christianity which would be contradictory to article 44 which guarantees freedom of religion. Bringing in a pluralist version of the blasphemy law, which the constitution specifically requires to be a crime, is just an effort to make it a workable law.

Obviously no one wants this, but constitutional reform requires a referendum and apparently that'd be too much hassle.

Strange they don't mind holding a 2nd referendum for Lisbon....
