For me, it feels like a slippery slope.

I don't like giving too much power to the executive, and in some ways, this would violate the balance of powers.

On the other hand, I despise pork, and this would be a great way to make it possible to cut a lot of it.

To get back on topic...

I can understand the underlying requirement for the bill. The infrastructure most critical to national security in the US is not monitored or controlled by any USG agency charged with network defense...nearly all of it is commercially monitored/controlled. That makes it impossible for DHS or DoD to do their national defense jobs (job #1 for both agencies) when it comes to critical infrastructure. Something needs to be done, but that bill ain't it.

The unfortunate truth is that most cyber policy is written by people who have a Ted Stevens-like understanding of networks. They think that because they have a computer on their desk at work and one at home that they are network experts. And then they start talking/writing.

The biggest thing those knuckleheads miss is that the private sector generally does a better job of network security than the public sector...because their livelihood depends on it. Additionally, many of these critical infrastructure sectors have much smaller networks making them easier to administer and secure than the sprawling government networks...but the ones making the policy approach it from a governmental perspective, thus ignoring much of the positives of the private system.

I would be interested to see how this would work logistically. Is the govt going to place sensors/controllers at each network operations center for each critical infrastructure segment? That seems pretty Big Brother-ish. Are they going to run in to the NOCs and put govt sysads on the commercial networks? Don't see how, even with standardized tools, there are still eccentricities to each network that only those who use/administer the network regularly truly grasp.

I just read this today

WASHINGTON (Reuters) - Cyberspies have penetrated the U.S. electrical grid and left behind software programs that could be used to disrupt the system, the Wall Street Journal reported on Wednesday.

The spies came from China, Russia and other countries, and were believed to be on a mission to navigate the U.S. electrical system and its controls, the newspaper said, citing current and former U.S. national security officials.
If these type of event(s) prompted the U.S. Govt. to create the Cybersecurity Act, then I am all for it. Personally I spent a couple weeks of locking out IP's from China on my Internet Router, the fookers.
